1. Scope of Services & Itinerary Flexibility

Pirata Experience ("Company," "we," "us," or "our") operates multi-day marine expedition tours between El Nido, Coron, and surrounding remote islands in Palawan, Philippines.

Itinerary Modifications: Due to the nature of open-sea navigation, tides, weather patterns, and Coast Guard regulations, all published itineraries are indicative only. We reserve the right to modify or substitute island stops, snorkeling spots, or routes at any time for guest safety. Route changes do not constitute a service failure and do not qualify for refunds.

2. Assumption of Risk & Liability Waiver

By booking a tour, you acknowledge that island expeditions carry inherent physical and marine risks, including open-water travel, marine life encounters, currents, and travel to remote areas with limited immediate access to medical facilities.

Voluntary Participation

You freely and voluntarily assume all risks, known and unknown, associated with your participation in the expedition.

Liability Release

You waive and release Pirata Experience and its crew from liability for personal injury, illness, or property damage, except in proven cases of gross negligence.

3. Physical Fitness, Health & Medical Declarations

Expedition tours require basic physical mobility (e.g., swimming short distances, walking on uneven beaches, boarding boats via ladders).

  • Pre-existing Conditions: Guests must declare severe health conditions, mobility limitations, or food allergies at the time of booking.
  • Medical Evacuation: Pirata Experience does not carry advanced medical equipment. All emergency evacuation, hospital, or medical transport costs remain the sole financial responsibility of the guest.

4. Captain's Authority & Guest Conduct

The Captain and Expedition Leader hold absolute operational authority on board for safety purposes.

Zero Tolerance: We strictly prohibit illegal drugs, excessive drunkenness, violence, harassment, or behavior that damages marine ecosystems (e.g., touching coral/wildlife). The Captain reserves the right to remove non-compliant guests at the nearest port without a refund.

5. Personal Belongings & Electronics Disclaimer

Marine expeditions involve exposure to salt water, sand, spray, and boat motion.

Pirata Experience accepts no liability for lost, stolen, water-damaged, dropped, or broken personal property (such as phones, cameras, or passports) during the trip. Guests are strongly advised to use waterproof dry bags.

6. Payments, Cancellations & Refunds

All deposits, final payments, cancellation terms, Coast Guard gale warning policies, emergency refund parameters, and payment processing fees are strictly governed by our incorporated Cancellation and Refund Policy.

7. Media Release & Marketing Consent

During the expedition, our crew or photographers may capture photos, videos, or drone footage of the journey.

By participating, you grant Pirata Experience a royalty-free license to use promotional media featuring your image on our website, social media, and marketing channels. If you wish to opt out, notify us in writing prior to departure at bookings@pirataexperience.com.

8. Travel Insurance Requirement

We strongly recommend purchasing comprehensive travel and medical insurance prior to your trip covering trip cancellations, medical emergencies, emergency sea evacuation, and lost luggage. We can issue confirmation certificates upon request to support your insurance claims.

9. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any legal claims or disputes arising from our services shall fall under the exclusive jurisdiction of the competent courts of Palawan, Philippines.
